Terms of Service

1. Acceptance of Terms

By accessing or using Gigzys ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. These terms apply to all users including customers, service providers, and visitors.

2. What Gigzys Is

Gigzys is an online marketplace that connects independent service providers ("Providers") with customers seeking local services ("Customers"). Gigzys is not a party to any agreement between Providers and Customers, does not employ Providers, and does not guarantee the quality, safety, or legality of services offered.

Gigzys charges Providers a flat monthly subscription fee for access to the platform. Gigzys does not charge Customers and does not take a commission on any transaction between Providers and Customers.

3. Provider Accounts

To list services on Gigzys, Providers must:

Special requirements: Providers offering childcare, elder care, food handling, or licensed trades (electrical, plumbing, HVAC, etc.) are responsible for holding and maintaining any required state or local licenses. Gigzys may request proof of licensure and reserves the right to remove listings that do not comply.

License verification disclaimer: Gigzys may display license or certification documents uploaded by Providers, but Gigzys does not independently verify the authenticity, validity, or current status of any license or credential. Customers are solely responsible for verifying a Provider's licenses directly with the appropriate state licensing board before hiring for any licensed work. Background checks: Gigzys does not perform background checks on Providers. Customers are responsible for conducting their own due diligence, including background checks, reference checks, and license verification, before engaging any Provider.

Insurance: Gigzys does not verify whether Providers carry general liability insurance or workers' compensation coverage. Customers should ask Providers directly about their insurance coverage before hiring.

Providers are independent contractors, not employees of Gigzys. Gigzys does not withhold taxes, provide benefits, or control the manner in which services are performed.

4. Customer Accounts

Customers may browse the platform without an account. An account is required to save providers, contact providers, leave reviews, or use the job tracking features. By creating an account you agree to provide accurate information and keep your login credentials secure.

5. Reviews and Ratings

Reviews may only be submitted by verified customers who have completed a job with a provider through the Gigzys job tracking system. Reviews must be honest, accurate, and based on direct experience. Gigzys reserves the right to remove reviews that are fraudulent, abusive, or violate these terms.

Providers may not solicit fake reviews or offer incentives in exchange for positive reviews.

7. Payments and Refunds

Provider subscriptions are billed monthly through Stripe. Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through the provider portal; cancellation takes effect at the end of the current billing period.

Gigzys does not process payments between Providers and Customers. Any financial disputes between Providers and Customers are solely between those parties. Gigzys is not liable for disputes over services rendered or not rendered.

Subscription refunds are not guaranteed but may be considered on a case-by-case basis for billing errors. Contact [email protected] for billing issues.

7b. Disputes Between Users

Gigzys is not a party to any agreement between Providers and Customers and is not responsible for resolving disputes between them. Any dispute regarding services, payment, quality, or conduct must be resolved directly between the Provider and Customer. Gigzys may, at its sole discretion, remove a listing or suspend an account if a pattern of complaints is reported, but is not obligated to do so.

Gigzys strongly recommends that Customers and Providers communicate clearly about scope of work, pricing, and expectations before any work begins.

8. Limitation of Liability

Gigzys provides the platform "as is" without warranties of any kind. We do not guarantee that the platform will be error-free, uninterrupted, or that any provider listing is accurate or complete.

To the fullest extent permitted by law, Gigzys shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to damages from services performed by Providers.

Customers are responsible for performing their own due diligence before hiring any provider, including verifying licenses, insurance, and references.

9. Intellectual Property

The Gigzys name, logo, and platform design are the property of Gigzys LLC. Content submitted by users (photos, bios, reviews) remains the property of the submitting user, but by posting it you grant Gigzys a non-exclusive license to display it on the platform.

9b. Veteran Badge Policy

The Veteran badge is awarded only to providers who submit valid military documentation (DD-214, military ID, or VA card) and receive confirmation from Gigzys staff. Providers who misrepresent their veteran or active duty status will have their badge immediately removed and their account suspended. Falsely claiming veteran status is a violation of these terms and may be reported to appropriate authorities.

10. Termination

Gigzys reserves the right to suspend or terminate any account at any time for violation of these terms, fraudulent activity, or conduct that harms other users or the platform. Providers who are terminated for cause are not entitled to a refund of subscription fees.

11. Governing Law

These terms are governed by the laws of the State of Tennessee. Any disputes arising from these terms or your use of the platform shall be resolved in the courts of Anderson County, Tennessee.

12. Changes to These Terms

We may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. We will make reasonable efforts to notify users of significant changes.
